Terms of Service

Please read these terms carefully before using NordenVps services

1. Acceptance of Terms

By accessing or using NordenVps services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

Important: These terms constitute a legally binding agreement between you and NordenVps. Please read them carefully.

2. Services Provided

NordenVps provides Virtual Private Server (VPS) hosting services, including but not limited to:

  • Virtual server instances with dedicated resources
  • Network connectivity and bandwidth
  • Server management tools and control panels
  • Technical support and customer service
  • DDoS protection and security features
  • Layer 4 (L4) DDoS protection included with all plans

DDoS Protection

All NordenVps services include complimentary Layer 4 (L4) DDoS protection to safeguard against network-level attacks. For enhanced Layer 7 (L7) application-level DDoS protection, customers are requested to purchase additional protection packages through our support ticket system.

Service Availability

We strive to maintain service availability 24/7/365, but we reserve the right to perform scheduled maintenance with advance notice. Emergency maintenance may be performed with minimal notice when necessary to protect the integrity and security of our infrastructure.

3. Account Registration

To use NordenVps services, you must create an account and provide accurate, complete, and current information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Immediately notifying us of any unauthorized access
  • Ensuring all account information remains accurate and up-to-date

Age Requirement

You must be at least 18 years old to create an account and use our services. By creating an account, you represent that you meet this age requirement.

4. Acceptable Use Policy

You agree to use NordenVps services only for lawful purposes and in accordance with our Acceptable Use Policy. The following activities are strictly prohibited:

Prohibited Activities
  • Illegal Content: Hosting, distributing, or linking to any illegal content including pirated software, copyrighted material, or content violating intellectual property rights
  • DDoS Tools & Attacks: Hosting, using, or distributing DDoS tools, stressers, booters, or any attack tools. Attacking NordenVps infrastructure or any third-party networks from our services will result in immediate termination
  • Network Attacks: Launching DDoS attacks, DoS attacks, or any form of network-based attacks against NordenVps infrastructure or external targets
  • Malicious Activities: Distributing malware, viruses, ransomware, or engaging in hacking, phishing, or unauthorized network access attempts
  • Spam & Abuse: Sending unsolicited bulk emails, operating mail servers for spam, or any form of email abuse
  • Resource Abuse: Intentionally overloading servers, network abuse, or cryptocurrency mining without prior approval
  • Port & Network Scanning: Unauthorized port scanning, network scanning, or vulnerability testing through or from our services
  • Adult Content: Hosting pornographic or adult content without express written permission
  • Fraudulent Activities: Engaging in scams, fraudulent schemes, or deceptive practices
  • Hate Speech: Hosting content that promotes violence, hatred, or discrimination
Zero Tolerance Policy - DDoS & Network Attacks

Hosting DDoS tools, launching attacks, or scanning networks through our services will result in immediate permanent suspension with NO REFUND. This policy applies to all customers including resellers. We do not accept any excuses. Your account will be permanently banned and you will not be eligible for any refunds or data recovery.

Enforcement

Violation of this Acceptable Use Policy may result in immediate suspension or termination of services without refund. We reserve the right to report illegal activities to appropriate authorities.

5. Payment & Billing

Payment Terms

All services must be paid in advance for the selected billing cycle (monthly, quarterly, annually). We accept payment via credit card, PayPal, and other approved payment methods.

Billing Cycles

Services are billed on a recurring basis according to your selected billing cycle. You authorize us to charge your payment method automatically for each billing period until you cancel.

Refund Policy

  • New Customers: 7-day money-back guarantee for first-time purchases (refund available within 7 days of initial order)
  • Service Renewals: Refund requests for renewed services must be submitted within 24 hours of the renewal charge
  • Early Cancellations: No refunds for services cancelled after the applicable refund period has expired
  • Policy Violations: No refunds for accounts terminated due to policy violations, including but not limited to DDoS attacks, hosting attack tools, or network scanning
  • Downgrades: No refunds for downgrades or changes in service plans

Late Payments

Failure to pay invoices on time may result in service suspension. Services suspended for non-payment exceeding 7 days may be terminated and data deleted.

Price Changes: We reserve the right to modify pricing with 30 days advance notice. Existing customers will be grandfathered at their current rate for their current billing cycle.

6. Service Levels & Uptime

Uptime Guarantee

NordenVps guarantees 99.9% network uptime. This guarantee excludes scheduled maintenance and circumstances beyond our reasonable control including:

  • Scheduled maintenance (with 48-hour advance notice)
  • Emergency security updates
  • Third-party network or infrastructure failures
  • DDoS attacks or security incidents
  • Force majeure events

Service Credits

If we fail to meet our 99.9% uptime guarantee in a given month, you may be eligible for service credits based on documented downtime. Credits must be requested within 7 days of the incident.

7. Data & Backups

Your Responsibility

You are solely responsible for backing up your data. NordenVps is not responsible for data loss under any circumstances. We strongly recommend maintaining your own independent backup solutions.

Backup Services

Professional backup services are available for purchase through our support ticket system. These services are optional and provided as an additional convenience to our customers.

Data Recovery Policy

In the rare event that data loss occurs due to a fault on our infrastructure (not user error), and you have reported the issue within 24 hours, NordenVps will:

  • Make every reasonable effort to recover your data from our systems
  • Provide 2 days of additional VPS service time as compensation
  • Work with you to restore services as quickly as possible
Critical Data Warning

Data loss due to our infrastructure is extremely rare but never impossible. Always maintain your own independent backups of critical data. Professional backup solutions can be purchased via support ticket.

Data Retention

Upon service termination or cancellation, your data may be deleted within 7 days. We do not guarantee data retention after service ends.

8. Termination & Suspension

Termination by You

You may cancel your services at any time through your account dashboard. Cancellations take effect at the end of your current billing period. No refunds are provided for partial periods.

Termination by NordenVps

We reserve the right to suspend or terminate your services immediately, without notice, for:

  • Violation of these Terms of Service
  • Violation of Acceptable Use Policy
  • Non-payment of invoices
  • Fraudulent activity
  • Activities that threaten our infrastructure or other customers
  • Legal requirements or court orders

Effect of Termination

Upon termination, your right to access and use the services immediately ceases. All data may be deleted and cannot be recovered.

9. Limitation of Liability

Service Disclaimer

Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that services will be uninterrupted, secure, or error-free.

Limitation of Damages

To the maximum extent permitted by law, NordenVps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or other intangible losses resulting from:

  • Use or inability to use our services
  • Unauthorized access to your data
  • Service interruptions or downtime
  • Bugs, viruses, or harmful components
  • Errors or inaccuracies in content

Maximum Liability: Our total liability shall not exceed the amount you paid for services in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold NordenVps harmless from any claims, damages, losses, or expenses arising from your use of our services, violation of these terms, or infringement of any third-party rights.

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be notified via email or through your account dashboard at least 30 days before taking effect.

Continued use of our services after changes constitutes acceptance of the updated terms. If you do not agree to the changes, you must cancel your services before the changes take effect.
